Course Description

This five-hour course covers Oregon advertising regulations and misrepresentation in real estate transactions. It is a compliance course, not a marketing course. It teaches what Oregon's ORS and OAR advertising rules require of every advertisement a broker or principal broker runs, from a yard sign to an Instagram reel, and where the lines are that lead to discipline. You start with Oregon's advertising legal framework: how brokers must identify themselves and their brokerage, how properties may be represented, and how the public must be able to reach the responsible licensee.

From there the course moves through truth-in-advertising standards and misrepresentation, brokerage identity rules for teams and personal brands, and platform-specific compliance for Facebook, Instagram, YouTube, TikTok and Google. Federal marketing law is covered where it overlaps Oregon practice. A module on AI-generated content, virtual staging, drone photography and visual media addresses the disclosure questions those tools raise. The course closes with Oregon listing rules and a risk management plan you can put in place the same week.

Modules include: Oregon's Advertising Legal Framework; Truth-in-Advertising Standards and Misrepresentation; Brokerage Identity, Teams and Personal Branding; Social Media Platform-Specific Compliance; Federal Marketing Law; AI, Photography and Visual-Media Compliance; Oregon Listing Rules and Risk Management.

Oregon real estate advertising operates under a strict legal framework designed to protect consumers from deceptive practices. The Oregon Real Estate Agency regulates all promotional activities through two primary sources.

Oregon’s state licensing laws¹ establish the legal boundaries for your conduct, agency relationships, and discipline.

Additionally, the agency’s administrative rules provide the operational mandates for your daily practice.

In Oregon, advertising includes any meaningful communication designed to attract the public to your professional services. This covers print media, social media, and electronic communications. We will next examine the specific registered business name prominence requirements for advertising.

Three legal pillars govern how we market property in Oregon.

First, the state’s license law establishes the overarching business supervision structures required for all real estate marketing activities.

Second, as a seller’s agent, you must secure a written listing agreement before you can offer a property for sale or make any efforts to find a buyer.

Third, the Real Estate Commissioner has the direct enforcement authority to discipline licensees who publish misleading or untruthful advertising.

These foundational statutes underpin the state administrative rules, translating broad laws into specific, enforceable advertising requirements for registered business names.
