These Terms of Use ("Terms") govern your access to and use of the website located at Realestateschool.org, including all related pages, content, courses, applications, and services (collectively, the "Site"). The Site is owned and operated by Gorman Investments, Inc. d/b/a Realestateschool.org ("Company," "we," "us," or "our"), 707 Driftwood Lane, Edmonds, WA 98020.
Please read these Terms carefully. By accessing or using the Site, creating an account, or enrolling in or accessing any course, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, do not use the Site.
1. Acceptance and Changes to These Terms
By using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms, which may be modified or updated from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice (such as a notice on the Site or by email). Your continued use of the Site after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Site.
Certain features, courses, or services may be subject to additional terms presented to you at the point of access or purchase. Where additional terms apply, they are in addition to these Terms, and in the event of a conflict, the additional terms control for that feature, course, or service.
2. Eligibility and Accounts
You must be at least 18 years old and able to form a legally binding contract to use the Site or enroll in any course. By using the Site, you represent and warrant that you meet these requirements.
To access certain features or courses, you must register for an account. You agree to:
- provide accurate, current, and complete information, and to keep it updated;
- keep your login credentials confidential and not share your account with anyone else;
- be solely responsible for all activity that occurs under your account; and
- notify us promptly of any unauthorized use of your account.
Accounts are personal to you and may not be transferred, sold, or shared. We may suspend or terminate accounts that contain false information or that are used in violation of these Terms.
3. Courses, Enrollment, and License to Course Content
When you enroll in or purchase a course, you are not buying the course content itself. We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the course content solely for your own individual educational use, for the access period associated with that course.
Unless we expressly authorize it in writing, you may not:
- copy, reproduce, download (except where a download is expressly offered), record, screen-capture, stream, distribute, publish, or publicly display any course content;
- sell, resell, rent, license, or otherwise transfer access to any course or your account;
- use any course content to teach, train, or instruct others, or to create a competing or derivative course or product; or
- remove, obscure, or alter any copyright, trademark, or other proprietary notice.
Course access periods, formats (including slide-based delivery, downloadable materials, audio, and other features), and availability are described at the point of enrollment and may vary by state, course, and product. We may add to, modify, or update course content, sequencing, and delivery from time to time to maintain accuracy and regulatory compliance.
4. Educational Purpose; No Guarantee of Results; Regulatory Compliance
This section is important. Please read it carefully.
Our courses provide real estate education, including continuing education ("CE") and pre-license instruction. The Site and its content are provided for educational and informational purposes only and do not constitute legal, financial, tax, or professional advice. You should not rely on course content as a substitute for advice from a qualified professional or from the applicable regulatory authority.
You acknowledge and agree that:
- No guarantee of outcome. We do not guarantee that you will pass any licensing or other examination, obtain or renew any license, or achieve any particular result. Outcomes depend on your own effort, preparation, and other factors outside our control.
- You are responsible for confirming requirements. Real estate education requirements differ by state and change over time. You are solely responsible for confirming, with the Washington State Department of Licensing or the appropriate regulatory authority in your jurisdiction, that a given course satisfies your specific licensing or CE requirements before you enroll, and for confirming your own eligibility and standing.
- Course approval. Where a course is approved by a state regulator or accrediting body, that approval is limited to the specific course, state, and approval period indicated. Approval does not extend to other states, courses, or time periods.
- Completion and reporting. Completion of a course requires that you satisfy all applicable requirements, which may include seat-time tracking and enforcement, sequential and gated content delivery, and passing any required assessment at the score required by the applicable state or product. Where we report course completions or issue certificates of completion to a state agency, we will use reasonable efforts to do so accurately and timely based on the information in your account; you remain responsible for ensuring your account information (including your name and license number) is correct and for retaining your own records.
- Academic integrity. You agree to personally complete all coursework and assessments, to not misrepresent your identity or completion of any course, and to not share, distribute, or solicit assessment questions or answers. Misrepresentation of identity or completion may be unlawful, may jeopardize your license, and will result in termination of access without refund.
5. Payment, Pricing, and Refunds
Prices for courses and other products are stated at the point of purchase and are subject to change. You agree to pay all fees and applicable taxes for the courses and products you purchase, and you authorize us (or our third-party payment processor) to charge your chosen payment method.
Refund policy.
A full refund will be given within 30 days of purchase if the following conditions have been met:
- The student has completed less than 10 percent of the course.
- A written cancellation notice has been received within 30 days of purchase.
Approved refunds are returned to the original payment method, ordinarily within 30 days of receipt of cancellation.
No refund will be given after 30 days.
We may refuse, cancel, or limit any order, and may correct pricing errors, at our discretion. We are not responsible for charges imposed by your bank, card issuer, or internet or device provider in connection with your use of the Site.
6. Acceptable Use
You agree to comply with all applicable laws, regulations, and rules when using the Site, and you agree not to:
- access or use the Site in any way that could damage, disable, overburden, or impair it, or interfere with any other user's use of it;
- attempt to gain unauthorized access to any account, system, or network associated with the Site;
- reverse engineer, decompile, disassemble, scrape, or otherwise attempt to derive the source code or underlying structure of the Site or any software;
- use any robot, spider, or other automated means to access the Site except as expressly permitted;
- introduce any virus, malware, or other harmful code;
- impersonate any person or misrepresent your affiliation with any person or entity; or
- use the Site for any unlawful, fraudulent, or unauthorized purpose, or in violation of these Terms.
7. Intellectual Property
The Site and all of its content—including all courses, text, slides, images, audio, video, graphics, software, design, and the selection and arrangement thereof—are owned by Company or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. Title to the Site and its content remains exclusively with Company and its licensors, and you acquire no ownership rights by using the Site.
"Realestateschool.org," the Company logo, and other Company names and marks are trademarks or service marks of Company. Other trademarks and service marks appearing on the Site are the property of their respective owners.
Copyright complaints (DMCA). If you believe content on the Site infringes your copyright, please send a written notice to our designated agent at support@realestateschool.org containing the information required under the Digital Millennium Copyright Act (17 U.S.C. § 512), including identification of the work, the allegedly infringing material and its location, your contact information, a statement of good-faith belief, a statement of accuracy under penalty of perjury, and your physical or electronic signature.
8. Your Submissions
Some features may allow you to submit content, such as answers to assessments, handwritten or uploaded responses, messages, or other materials ("Submissions"). You retain ownership of your Submissions, but you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, and use your Submissions as reasonably necessary to operate the Site, deliver and grade your courses, provide our services to you, comply with applicable regulatory requirements, and maintain records. You represent that you have all rights necessary to provide your Submissions and that they do not violate any law or third-party right.
9. Third-Party Links and Services
The Site may contain links to, or integrate with, websites and services that we do not own or control. We provide these for convenience only and are not responsible for the content, accuracy, practices, or policies of any third-party site or service. Your use of any third-party site or service is at your own risk and subject to that third party's terms. We disclaim any warranty or guarantee regarding any third-party site, service, or content.
10. Privacy
Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Site, you consent to the data practices described in the Privacy Policy.
11. Electronic Communications and Consent
By using the Site or providing your contact information, you consent to receive communications from us electronically, including transactional and account-related messages (such as enrollment confirmations and completion notices) and, where permitted, informational or promotional messages. You may opt out of promotional messages at any time using the unsubscribe mechanism provided. You agree that electronic communications, agreements, and notices satisfy any legal requirement that such communications be in writing.
12. Information Accuracy and Availability
We make reasonable efforts to keep the information on the Site accurate and current but make no warranty as to its accuracy or completeness, and we may make additions or modifications to content, course text, and images at any time. The Site is accessible only through the internet, and we are not responsible for providing you internet access. The Site may be unavailable at times, with or without notice, due to maintenance, technical issues, or other causes.
13. Disclaimer of Warranties
THE SITE AND ALL CONTENT, COURSES, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, COMPANY MAKES NO WARRANTY OR REPRESENTATION OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL COMPANY OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE, COURSES, OR SERVICES, WHETHER OR NOT COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, COMPANY'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE, COURSES, OR SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO COMPANY FOR THE COURSE OR SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
15. Indemnification
You agree to indemnify, defend, and hold harmless Company and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Site, your Submissions, your violation of these Terms, or your violation of any law or third-party right.
16. Termination
We may suspend, revoke, or terminate your access to all or part of the Site, your account, or any course, at any time, with or without notice, if you violate these Terms or any of our policies, or as otherwise necessary to protect the Site, other users, or Company. Upon termination, your license to access course content ends. Provisions that by their nature should survive termination—including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution—will survive.
17. Dispute Resolution; Governing Law; Venue
Informal resolution first. Before filing any claim, you agree to first contact us at support@realestateschool.org and describe your dispute, and to make a good-faith effort to resolve it informally. Many disputes can be resolved this way.
Governing law. These Terms and your use of the Site are governed by the laws of the State of Washington, without regard to its conflict-of-laws principles.
Venue. Except as otherwise required by applicable law, you and Company agree that any dispute not resolved informally will be brought exclusively in the state or federal courts located in Snohomish County, Washington, and you and Company consent to the personal jurisdiction of those courts.
18. General
Entire agreement. These Terms, together with the Privacy Policy and any additional terms applicable to specific courses or features, constitute the entire agreement between you and Company regarding the Site and supersede any prior agreements.
Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
No waiver. Our failure to enforce any provision is not a waiver of our right to do so later, and no waiver of any provision will be deemed a continuing waiver of that or any other provision.
Assignment. You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.
Force majeure. We are not liable for any failure or delay in performance caused by events beyond our reasonable control.
