Terms of Use
IMPORTANT NOTICES FOR UTAH STUDENTS
ANY STUDENT ATTENDING REALESTATESCHOOL.ORG IS UNDER NO OBLIGATION TO AFFILIATE WITH ANY OF THE REAL ESTATE BROKERAGES THAT MAY BE SOLICITING FOR LICENSEES AT THIS SCHOOL.
THE UTAH DIVISION OF REAL ESTATE GRANTS EDUCATION WAIVERS FOR QUALIFIED INDIVIDUALS. A STUDENT ACCEPTED OR ENROLLED FOR EDUCATION HOURS CANNOT LATER REDUCE THOSE HOURS BY APPLYING FOR AN EDUCATION WAIVER. AN EDUCATION WAIVER MUST BE OBTAINED BEFORE A STUDENT ENROLLS AND IS ACCEPTED BY A SCHOOL FOR EDUCATION HOURS.
1. Acceptance
These Terms of Use apply to the Realestateschool.org website, mobile apps, and courses, and to any content, data, or information in them (together, the "website"). By using the website you agree to these Terms, which we may update from time to time. If you do not agree, do not use the website. Some areas of the website may have additional terms. Our use of the information you provide is governed by our Privacy Policy. For Utah course cancellations and refunds, see our Utah Refund Policy.
2. Who we are
The website is operated by Gorman Investments, Inc. doing business as Realestateschool.org, 707 Driftwood Lane, Edmonds, WA 98020. Questions: support@realestateschool.org or (425) 775-2313.
3. Copyright, trademark, and ownership
The website and all course content are owned by Realestateschool.org and protected by U.S. and international copyright law. All rights reserved. You may not copy, distribute, transmit, display, perform, reproduce, create derivative works from, publish, license, transfer, sell, or modify the website or any course. You may not reverse engineer, decompile, or disassemble the website, or remove any copyright notice, trademark, or attribution. Realestateschool.org, its logos, and its other marks belong to Realestateschool.org. Other marks belong to their owners.
4. Your account, identity, and conduct
- You agree that the information you give us is accurate, and that you will update it when it changes.
- Your account is for you alone. Only the registered student may log in, study, or take quizzes and exams. Do not share your password or let anyone else work in your account.
- We may verify your identity during the course. If someone other than the registered student completes any part of a course, or if you misrepresent your identity, we will withhold or cancel your certificate, remove you from the course, and may report the matter to the Utah Division of Real Estate. Fees are not refunded in that case.
- You agree to follow all laws and rules that apply to your use of the website, and to treat instructors, staff, and other students with respect in any forum, Q&A, or message.
5. Attendance, course access, and completion
- Attendance. Online attendance is measured by your logged study time and your progress through each lesson. You must complete at least 90% of the course's scheduled instruction, not counting breaks, and all required lessons, quizzes, and assessments.
- Daily limit. You may earn no more than 8 credit hours per day in Utah courses.
- Access period. Each course has an access period, shown at checkout for that course, to complete it. Contact support before your access ends if you need more time.
- Completion. To complete a course, you must meet the attendance rule above, finish every lesson, and pass each quiz and the final exam with the minimum score shown for that assessment.
- Reporting. We report your completion to the Utah Division of Real Estate within 10 days of the course, for pre-license and continuing education courses alike, as Utah requires. To be reported, you must give us your accurate name and license number within 7 business days of finishing. Your continuing education credit counts for renewal only after it is reported.
- Exam prep is not CE. Exam-preparation courses do not count toward Utah continuing education.
6. Criminal history
A criminal history may affect your eligibility for a Utah real estate license. Before you pay for a Utah pre-license course, we give you the Division's criminal history disclosure and ask you to sign that you have read and understood it. We also ask you to confirm that you have not obtained an education waiver from the Division. When you apply for a license, the Division will require you to:
- accurately disclose your criminal history on the Division's licensing questionnaire;
- submit fingerprints and consent to a criminal background check; and
- provide complete court documents for any criminal proceeding you are required to disclose.
The Division considers your criminal history when it decides your application. We do not decide license eligibility. For questions about your situation, contact the Utah Division of Real Estate before you enroll.
7. Course content and changes
We keep courses current with Utah law and Division rules. When a law or rule changes, we may update lessons, quizzes, or exams, including while you are enrolled. We make no warranty that general information on the website (outside approved course content) is complete or current.
8. Course approval
Utah courses are offered only after the Division has certified our school and approved the course. Your certificate shows the course's Utah approval number.
9. Access and technology
The website is available only over the internet, and you are responsible for your own internet access and a supported device and browser. The website may sometimes be unavailable, with or without notice.
10. Limited warranty; disclaimer
EXCEPT AS STATED IN THESE TERMS, THE WEBSITE IS PROVIDED "AS IS". REALESTATESCHOOL.ORG MAKES NO OTHER WARRANTY OR REPRESENTATION OF ANY KIND, INCLUDING ANY WARRANTY OF NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE THAT YOU WILL PASS ANY LICENSING EXAM OR RECEIVE A LICENSE.
11. Limitation of liability
TO THE EXTENT ALLOWED BY LAW, REALESTATESCHOOL.ORG IS NOT LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE WEBSITE, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE.
12. Links to other websites
The website may link to sites we do not own or run, including the Utah Division of Real Estate and the exam vendor. We are not responsible for their content.
13. Termination
We may suspend or end your access if you break these Terms or our policies. If we end your access for a reason other than a breach of these Terms, your refund rights under the Utah Refund Policy still apply. Gift purchases, including a gift you buy for someone else, are covered by the same Utah Refund Policy.
14. Student records and privacy
We handle your student records under our Privacy Policy and applicable law. These records include your account and enrollment information, course progress, attendance and time logs, assessment results, completion and certificate records, and any criminal history disclosure you signed. We keep student records for at least 5 years after course completion, which is longer than Utah's 3-year requirement. You may ask for access to or a copy of your records, or ask us to correct information, at support@realestateschool.org or (425) 775-2313. We may verify your identity first.
15. Non-discrimination
Realestateschool.org does not discriminate on the basis of race, color, national origin, ancestry, religion or creed, sex, gender, gender identity or expression, sexual orientation, marital or familial status, age, disability, veteran or military status, genetic information, or any other status protected by federal, state, or local law, in admission to, access to, or operation of our courses, including enrollment, instruction, assessment, and certificates. If you believe you have been treated unfairly, contact us first at support@realestateschool.org. You may also contact the Utah Division of Real Estate (see "Complaints and the regulator" below).
16. Governing law and courts
These Terms are governed by the laws of the State of Washington, except where applicable law requires otherwise. Court proceedings arising from these Terms must be brought in the state courts in Snohomish County, Washington, subject to the rights below. Nothing in these Terms limits any right you have under Utah law to bring or defend a claim in Utah, or any protection that cannot be waived by agreement. Nothing in this section limits your right to complain to the Utah Division of Real Estate.
